1- GENERAL
The present general conditions of sale have for object to govern the contractual relations between the company CONTACT PLANTES parent company of VINTAGE VEGETAL (trade name) – and whose head office is Fleurs 508 120 Avenue des pépinières – 94648 RUNGIS MIN Cedex (The company CONTACT PLANTES is a member of a consolidated group whose parent company is GROUPE VEGETAL) and the Customer, also called Buyer, defined hereafter as the user of the site http://www.vintagevegetal.com, and accepting the present general conditions of sale.
Any other condition, of any nature whatsoever, can only commit CONTACT PLANTES after written confirmation from the company. The information on this site is given as an indication only and can be modified by CONTACT PLANTES without notice. The mere fact of placing an order on the site http://www.vintagevegetal.com implies acceptance without reservation of these general conditions of sale.
2- ORDER TAKING PROCESS ON THE INTERNAL WEBSITE http://www.vintagevegetal.com
Our products are highlighted on the website http://www.vintagevegetal.com with a non-contractual photo and a description. As these are unique and antique pieces, colors, volumes and finishes may vary. If this is the case, it will be clearly indicated in the product sheet.
The prices are displayed exclusive of tax, excluding any shipping costs, only after logging into the professional customer account via the e-mail field / login and password (defined by the customer). These prices are subject to regular changes, without anyone being able to take advantage of any prior pricing. To place an order, the buyer must enter the product sheet of the desired item, click on the item and add it to the cart.
The order is possible by unit. The order summary, or basket, summarizes the quantities and prices selected.
After validating their order, the customer will receive an email indicating that the order has been received by the Végétal Rungis sales teams, who will take charge of and check the available items. The order can then be modified, always according to availability. It is only after this verification that the customer will receive his final order and will be able to pay it directly with Végétal Rungis and outside the site, either by bank transfer or by distance selling
If a product is unavailable despite its presence on the site, our teams will contact the buyer to define the action of replacement.

The information provided by the buyer during the order process commits him to the truthfulness and accuracy of the recipient’s details. Végétal Rungis cannot therefore be held responsible for the impossibility of delivering the product.
3- ORDERS
Any order must be placed at least 24 hours in advance, or earlier for certain products, and implies by right on the part of the purchaser the acceptance of our conditions of sale and the clause of reserve of property.
. Events beyond our control may modify previously determined rates. An order not taken or cancelled too late may result in the impossibility for the customer to recommend later.
????? Any product left in storage on the premises of the company Végétal, will be subject to a guarding cost of €5 per day and per packaging unit (cart or pallet).
An order will only be shipped or picked up by the customer when it has been paid in full by the buyer/customer.
4- COMPLAINTS
Any complaint concerning the nature, the quality, the price of the product must be formulated within 12 hours by email to decoration@vegetal.fr . Claims on quantities are not possible after leaving the warehouse and the checkpoint. Végétal refuses to accept responsibility for damage caused by the customer to the products in the store and, even more so, during loading in the parking lot.
. For decorative items, the quality and function check is done before the goods are collected. Any subsequent claim will be denied. The products are sold without warranty.
5-RULES
Végétal-Rungis remains the owner of the goods until the invoice is paid in full. The accepted means of payment available are bank cards (Carte Bleue, Visa, Eurocard, Mastercard accepted in France). The validation of the order by credit card is a mandate to pay the price of the order including all taxes, postage and accessories. The customer must transmit the number of the card, the date of validity and the name of the carrier. Via our secure credit card payment system, the customer can safely transmit the type of card (Carte Bleue, Visa, Eurocard, Mastercard), the card number, the date of validity and the name of the card holder (name appearing as it is on the card). In the event that this system is sometimes unavailable, the payment by credit card will be replaced by a payment in the form of VAD (Distance Selling) with the information of the credit card.

Citelis intervenes in the course of a sale on the Internet as soon as the customer chooses payment by bank card (CB national, Visa, Eurocard Mastercard…).

Security is provided by both :
– encryption of data transferred over the network,
– the absence of storage of the banking coordinates of the customers on the site, the payment being done on our banking service,
– and an authorization request for any transaction to verify the validity of the card and the funds on the account.
The payment by credit card is perfectly secured; your order will be registered and validated as soon as the payment is accepted by the bank you have chosen
Any delay in payment will result in a financing cost of 5.84%, calculated on the basis of the legal interest rate. A fixed indemnity of 40 Euros for collection costs in case of late payments is also added. The Commercial Court of CRETEIL (94-Val de Marne) will be competent to deal with any dispute. The higher, contentious collection costs remain at the debtor’s expense. No discount rate is applicable.
There are several options for paying for your off-site orders:
– Payment in store or by credit card: You have an account registered with Végétal so you can select this option. According to the terms that were established at the time of creation you are allowed to choose this payment method.
You can pay for your order by picking it up at the store.
You will be able to pay by credit card by phone when a cashier contacts you.
– Payment by bank transfer: You have an account registered with Végétal so you can select this option. We invite you to make your transfer as soon as you receive the invoice at the time of the payment request and to send us the proof of this transfer by email so that we can take into account this payment and thus send your order.
– Setting up an account : This method of payment is only accepted after approval by the management of Vintage Végétal according to the terms and conditions established at the time of the creation of the account and for customers who already have a customer account registered with Végétal (see: GTC).
In all cases, your choice of payment will be verified by our teams before any shipment.
Payments that are not made before the date of departure or pick-up of the order will result in the order not being shipped or made available.
6- DELIVERY
All goods delivered must be paid for before departure. Deliveries are planned and organized several days or weeks in advance, we work with reliable carriers who practice groupage, which allows to optimize the cost of transport for the customer. The form concerning the general conditions of sale must be filled in order to validate the delivery… Our store/online prices are exclusive of shipping costs. The participation in the transport is defined according to geographical zones, the volume of the bought parts and the conditioning of the delivered products (ex on pallet). The unloading is on the first floor, the driver alone does not put the delivered products in place. The buyer must be present to assist the driver. Vintage Végétal disclaims all responsibility and may charge for transport in the event of an incomplete or erroneous address, refusal of delivery or lack of information preventing delivery on the day.
All claims must be made in the presence of the driver. Non-conforming goods must be returned immediately by the driver. The delivery note must be signed upon receipt of the goods. Vintage Végétal does not have the legal authorisation to transport goods from other operators, any product transported must be invoiced on the Végétal heading.
The deliveries, especially in the Paris area, force us to have a lot of reservations about the established schedules. In general, we deliver “within the day” and try to take into account the wishes of our customers. The delivery time cannot be fixed exactly.
7- RENTAL OF FURNITURE AND OBJECTS
Each rented piece remains the property of Vintage Végétal. The quotations for the rental of furniture and objects are valid for 7 days. Rentals are based on potential stock availability, with a 48-hour lead time. Systematic packaging and protection of breakable products
A rental requires a deposit of the sum of the sales prices excluding taxes of each room. The cost of the rental is according to the duration. Any deterioration will result in the invoicing of the part at its selling price excluding taxes.
8- RIGHT OF WITHDRAWAL
According to article L121-16-1 III. of the Consumer Code, companies employing less than five employees, whose contract concluded off-site does not fall within the scope of their main activity, have the right to withdraw from their order without giving any reason within 14 days from the date of payment.
Non-perishable, non-personalized products
For all orders of non-perishable products, you have a period of 14 days to exercise your legal right of withdrawal from the receipt of your order. The products must be in the same condition as when received, and in their original packaging.

The return costs are at the customer’s expense, and the product must be shipped no later than 14 days after the confirmation of the acceptance of the return which is done by email. Refunds only concern products, and are credited in the form of a credit note after receipt of the products. Any return of goods requires the prior agreement of the company Vintage Végétal.
9- RETENTION OF TITLE AND LIABILITY
The company Vintage Végétal retains ownership of the goods until they have been paid for in full by the customer. The transfer of property of the products to the customer is carried out at the time of the integral payment of the price. However, during the period between delivery and transfer of ownership, the risk of loss, theft or destruction is borne by the customer.
The company Vintage Végétal has, for all the stages of access to the site, the process of the order, the delivery or the posterior services, only an obligation of means. Vintage Végétal cannot be held responsible for any inconvenience or damage inherent in the use of the Internet network, in particular a break in service, an external intrusion or the presence of computer viruses, or for any event qualified as force majeure, in accordance with case law. It is also recalled that the secrecy of e-mail correspondence transmitted over the Internet is not guaranteed when they are not subject to specific protocols.
Vintage Végétal cannot be held responsible for the information published and the accuracy of the data presented on the recommended sites, the partner sites and any other link established from the http://www.vintagevegetal.com site. The brands possibly quoted on these sites belong to their respective owners.
10- CONFIDENTIALITY AND ARCHIVING OF DATA
Vintage Végétal reserves the right to collect data on the user, in particular through the use of cookies. The user is informed that this automated processing of information, including the management of e-mail addresses, has been declared to the CNIL. In accordance with the law 78-17 of January 6, 1978, the customer has at any time a right of access, modification, rectification and deletion of the data which concern him.

The computerised registers, kept in the computer systems of Contact Plantes/Végétal Rungis SAS and its partners under conditions of reasonable security, shall be considered as proof of communications, orders and payments between the parties. The filing of the purchase orders and invoices is carried out on a reliable and durable support so as to correspond to a faithful and durable copy in accordance with article 1348 of the Civil code.
General Data Protection Regulation (GDPR): Following your request to open an account, Contact Plantes pour Vintage Végétal, a member of the Groupe Végétal -Rungis, will only keep the professional details of your companies, as entered in our customer database, the possible origins of which are your KBIS, the infogreffe, and any information you may have given us. As well as the contact details, necessary for our commercial exchanges.
This data is protected, accessible only through our business application, and disclosure is prohibited. They are used solely within the framework of our commercial relationship, in an exclusive link between your company and Contact Plantes pour Vintage Végétal and member of the Groupe Végétal Rungis SAS. You have the right to access and rectify this data if it is erroneous, and within the limits of the data necessary to establish your invoices in compliance with the regulations. You can request the deletion of any data if you wish to close your customer account, after payment of all outstanding amounts due from your company.
11- INTELLECTUAL PROPERTY
All elements of the http://www.vintagevegetal.com website, whether visual, textual or audio, including the technology used to implement it, are protected by copyright, trademarks and patents. They are the exclusive property of the company Contact Plantes pour Vintage Végétal. The user who has a personal Internet site and who wishes to place, for personal use, on his site a simple link referring directly to one of the pages of the site http://www.vintagevegetal.com, must request prior authorisation from Contact Plantes pour Vintage Végétal and a member of the Groupe Végétal Rungis SAS, which reserves the right to reverse its decision at any time, and therefore to request the termination of the operation. The authorization will be in writing and will mention the obligation for the applicant to mention his source in a clear and nominative way. This will not be an implicit affiliation agreement. On the other hand, any hypertext link referring to the site http://www.vintagevegetal.com and using the technique of framing or in-line linking is formally prohibited. 12- ATTRIBUTION OF JURISDICTION
The contractual information is presented in French and the products offered for sale comply with French and European regulations. If necessary, it is up to the foreign customer to check with the local authorities the possibilities of use of the product he/she is considering ordering. The company Contact Plantes pour Vintage Végétal and member of the Groupe Végétal Rungis SAS cannot be held responsible in case of non-respect of the regulations of a foreign country.
All disputes relating to the formation, performance and termination of contractual obligations between the parties which cannot be settled amicably shall be submitted to the jurisdiction of the Commercial Courts of CRETEIL (Val de Marne), in whose jurisdiction the head office of Contact Plantes, a member of the Groupe Végétal Rungis SAS, is located.
